Court dissolves doctor’s marriage over adultery

The sale and sharing of properties jointly owned by an Ibadan-based medical doctor identified as Dr Oluseyi Adebusuyi Seyi-Ojo and his wife, Mrs Olukemi Yewale Seyi-Ojo has been ordered by an Ibadan High Court in Oyo state.

Justice L. A. Ganiyu ordered that two of the properties-the Ayokemi Hospital building and Dormon Pharmaceutical buildings, both at Monatan area of Ibadan- are to be sold to persons unrelated to both parties.

The proceeds, the judge held, should be shared between the duo.

Justice L. A. Ganiyu made the order while delivering judgment in a suit filed by the petitioner Mrs Seyi-Ojo.

The petitioner had approached the court for a Decree of Dissolution of Marriage against her husband, the respondent.

She stated that the marriage had broken down irretrievably, alleging that the respondent committed adultery, hence she found it intolerable to live with him.

The petitioner further informed the court that she had lived apart from the respondent for two years and could no longer return to the marriage.

She sought an order of the court to have custody of the second son of the marriage and an order directing the respondent to contribute to the upkeep of the son.

She further prayed for an order ceding to her the hostel in Ogbomoso and the matrimonial home at Akanni Aluko Street, Monatan, Ibadan as well as a parcel of land in Iwo.

The petitioner also prayed for an order directing the sale of Ayokemi Hospital at Monatan, Ibadan, and all other houses except the house bought in the name of the children, and for the proceeds to be shared equally.

In his ruling, Justice Ganiyu granted the petitioner’s prayers and ordered the sale and sharing of the properties that are jointly owned by the couples.

The court also granted the sale of the Ayokemi Hospital building located at Dejo Dairo Street, Monatan Ibadan, while the custody of the second son was not granted as the court held that he is old enough to choose where he will live.

The court ordered that the tuition fee should be shared by the parties but a maintenance fee of N250, 000 is to be paid by the respondent till the boy is gainfully employed.
