COCT set to petition Supreme court to be allowed to prevent land grabs

COCT set to petition Supreme court to be allowed to prevent land grabsThe City of Cape plans to petition the Supreme Court of Appeal in its fight to be allowed to prevent land grabs.

Some weeks back, the Western Cape High Court ruled that land evictions is not allowed during the country’s current state of disaster.

As a result of the court’s ruling, the city applied for leave to appeal the judgment.

On Thursday, the leave application was dismissed.

Mayor Dan Plato who was displeased with the High Court’s ruling to dismiss the city’s appeal application said that they would take the matter to the supreme court.

“We will petition the Supreme Court of Appeal to take our case directly to the SCA. We have to do that in the interests of the citizens of the city.”

He said that if this is not approved, land invasions would continued unchecked.

Plato said that the right to counter-spoliate is very important to the city’s land protection efforts.

The South African Human Rights Commission that presented the matter to the court declared counter-spoliation unlawful and requested for the amendment of the  for the common law.
